WHIPLASH INJURY

The most common accident in the UK is a road traffic accident. The most common form of injury is a whiplash injury, which is a soft tissue injury of the neck. Often, there is also soft tissue injury to the back. Sometimes these injuries can be quite debilitating. It is also common to find that immediately after the accident there appears to be no injury but that the victim begins to suffer from symptoms many hours later.

Whiplash injury commonly lasts for months before it gradually improves. Some unfortunate victims can suffer from neck pain for several years.

FATAL ACCIDENTS

Sadly, accidents can cause serious injury or even death. If that accident has been caused by the fault of another, the deceased’s representatives can often make a claim on behalf of the deceased and sometimes on behalf of dependants and/or partner or spouse.

PSYCHOLOGICAL INJURIES

Many people who have suffered physical injury as a result of an accident also suffer from a psychological injury. Symptoms can be severe and might include flashbacks, nightmares and depression. Other symptoms might be mild, including anxiety and travel avoidance. Psychological injuries can be categorised as serious (such as Post-Traumatic Stress Disorder) or mild (such as anxiety).   • Mr. X. and his family were walking along a pavement one evening when two cars were in collision as a result of which one car mounted the pavement, injuring several members of the family. Even those members not physically hit by the car were affected psychologically. Liability was admitted by the Insurance Company of the car driver and compensation was recovered for each member of the family. As several members of the family were children, their compensation claims had to be approved by the Court and the compensation has been paid into the Court to be paid out to the children when they become 18.
  • Mr. X. was standing in a car park when a car was driven into him, as a result of which he suffered injuries to his knee, foot and right thumb. Within six months he had fully recovered. Liability was accepted and Poole Townsend achieved a settlement for Mr. X. of £4,500.00 in respect of his injuries. Driving Accidents/Road Traffic Accidents/Whiplash Injury Mr. D. was driving his car when a vehicle pulled out of a junction into the side of his car. Mr. D. was very shocked and shaken up, suffered from headaches and whiplash injury to his neck and soft tissue injuries to his shoulder. Liability was agreed and Poole Townsend successfully recovered £4,000.00 for Mr. D’s injuries.
  • Miss S. was a front seat passenger in a vehicle which pulled out into the path of another vehicle, causing a collision. Miss S. suffered whiplash injury to her neck and soft tissue injury to her back as a result of which she was off work for one month. Poole Townsend successfully recovered compensation of £4,500.00 for Miss S. in respect of her injuries and loss of earnings.
  • Mr. C. was driving when he stopped at a junction. The car behind him collided with his vehicle as a result of which Mr. C. suffered from whiplash injuries to his neck, back and shoulders. He had fully recovered from his injuries within a year. Poole Townsend successfully recovered £8,000.00 compensation for him in full and final settlement of his claim for his injuries.
  • Miss F., a child aged 11, was injured crossing the road. Liability was disputed by the Insurance Company. Miss F’s injuries were serious and included a head injury which had caused some brain damage. Miss F. also suffered from a broken arm and leg. Miss F’s family brought a claim on her behalf against the car driver’s Insurance Company. This took many years to settle because the full extent of Miss F’s brain injury took some time to be assessed. Poole Townsend arranged investigation by many different experts including Clinical Neuro-Psychologists, orthopaedic experts and rehabilitation experts. Her claim was eventually settled for over £1million.
  • Mr. W. was knocked off his motorbike as a result of which he suffered multiple injuries including a spinal injury, a whiplash injury to his neck and serious leg injuries. After negotiations liability was finally admitted and settlement achieved for the motorcyclist in excess of £100,000.00. This included a substantial payment for loss of earnings.
  • Mr. X. was a passenger in a vehicle which overturned and as a result Mr. X. suffered from serious spinal injuries. Unfortunately, Mr. X. was so badly injured that he was rendered paraplegic and is now confined to a wheelchair. After protracted and lengthy negotiations, due to the fact that Mr. X. took a long time to recover sufficiently from his injuries to be able to give an accurate prognosis for the future, settlement was eventually reached in excess of £1million.
  • Mr X was involved in a pile-up on the motorway. The vehicle was shunted from behind and he sustained a whiplash injury to his neck and back. He recovered £7,500.00 in compensation.
